1. OVERVIEW

This website is operated by ZOIC PalaeoTech Limited, trading as ZOIC PalaeoTech. Throughout the site, the terms “we”, “us” and “our” refer to ZOIC PalaeoTech Limited.

We offer this website, together with all information, tools and services available from it, to you on the condition that you accept these Terms of Service. By accessing or using any part of the website, or by purchasing any products from us, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access the website or use any services.

Our online store is hosted by Shopify, which provides the e-commerce platform enabling us to offer our goods and services.

4. PRODUCTS AND INTENDED USE

ZOIC PalaeoTech supplies specialist fossil preparation tools, equipment and associated materials intended for professional, educational and hobbyist use.

You acknowledge and agree that all Goods must be used strictly in accordance with their intended purpose. You are solely responsible for ensuring that appropriate training, supervision and safety precautions are in place prior to use, including the use of suitable personal protective equipment where required. You further accept full responsibility for ensuring that all users are competent and understand the risks associated with the Goods.

We accept no responsibility for any injury, loss or damage arising from misuse of the Goods, from use outside their intended purpose, or from failure to follow appropriate safety practices.


5. CHEMICALS AND HAZARDOUS GOODS

Where Goods include chemicals or other hazardous materials, you expressly acknowledge that such products carry inherent risks. By purchasing such Goods, you confirm that you are competent to handle, store and use them safely and in compliance with all applicable laws and regulations.

You agree that you will not use such materials in an unsafe manner, nor combine them with other substances without appropriate knowledge and precautions, nor supply them to individuals who are not legally permitted or suitably qualified to use them. You further agree to comply with all relevant transport, storage and disposal regulations.

We reserve the right to refuse or cancel any order for hazardous Goods where, in our reasonable opinion, it is necessary to do so in order to ensure compliance with legal or safety requirements.


6. ORDERS AND CONTRACT FORMATION

All orders placed through the Website are subject to acceptance by us. A legally binding contract is formed at the point at which you complete the checkout process.

We reserve the right, at our sole discretion, to refuse or cancel any order at any time, including where we suspect that an order has been placed for resale, unauthorised distribution, or any other purpose inconsistent with these Terms. 7. PRE-ORDERS AND MADE-TO-ORDER GOODS

Certain Goods are supplied on a pre-order basis or are manufactured to order. In such cases, production may commence following the placement of your order.

If you choose to cancel a pre-order prior to completion, we reserve the right to retain a non-refundable amount equivalent to five percent of the total order value. This sum represents a genuine contribution towards administrative, scheduling and production costs incurred.

Where Goods are custom-made, personalised or otherwise produced to your specification, your statutory right to cancel may not apply where permitted by law.


8. PRICES AND AVAILABILITY

All prices are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time without liability. While we make reasonable efforts to ensure that product descriptions and pricing are accurate, errors may occur and we reserve the right to correct any such errors and to cancel orders where necessary.


9. DELIVERY AND RISK

For Consumers, risk in the Goods passes upon delivery to the address provided. For Business Customers, risk passes at the point of dispatch.

You are responsible for ensuring that delivery details are accurate and complete. We shall not be liable for delays or failures in delivery arising from incorrect information provided by you.


10. RETURNS AND REFUNDS

Returns and refunds are governed by our separate Returns Policy, which forms part of these Terms. Nothing in these Terms shall affect your statutory rights as a Consumer.


11. INTELLECTUAL PROPERTY AND PRODUCT RESTRICTIONS

All intellectual property rights in the Website, the Goods, and all associated materials, including but not limited to product designs, specifications, images, text and branding, are owned by or licensed to ZOIC PalaeoTech Limited.

For Business Customers, our total liability shall in all circumstances be limited to the amount paid for the Goods. For Consumers, we shall only be liable for losses that are reasonably foreseeable.

You agree to indemnify and hold harmless ZOIC PalaeoTech Limited from and against any claims, losses, damages or expenses arising from your misuse of the Goods, your breach of these Terms, or your failure to comply with applicable laws or regulations.
